Mr. Vo Hai Son, Deputy Director of the Department of Disease Prevention under the Ministry of Health, affirmed that the health declaration regulation under Decree No. 165/2026/ND-CP, which takes effect on July 1, 2027, should not be understood as being mandatory and regularly applicable to all persons entering, exiting, or transiting at all times.
The Ministry of Health provides information on health declaration regulations for exit and entry from July 1, 2026
Recently, several readers sent letters to the Government News expressing concerns about certain issues related to the regulation that, from July 1, 2026, tourists coming to Viet Nam must make a health declaration upon entry and submit the declaration through the website at “https://tokhaiyte.vn”.
Health declaration is not mandatory for all persons entering, exiting, or transiting
In response to this issue, Mr. Vo Hai Son, Deputy Director of the Department of Disease Prevention under the Ministry of Health, stated that Clause 2, Article 22 of Decree No. 165/2026/ND-CP, issued on May 15, 2026, provides for health declarations for persons entering, exiting, or transiting. Accordingly, the Minister of Health shall provide guidance on the subjects and timing for applying health declarations at border gates for each infectious disease, based on the global infectious disease situation and the risk of disease entry into Viet Nam at each specific time. Therefore, the health declaration regulation under Decree No. 165/2026/ND-CP is not mandatory or regularly applicable to all persons entering, exiting, or transiting at all times, from July 1, 2026. The application of health declarations at border gates will be carried out in accordance with the guidance of the Minister of Health for each infectious disease, in line with the disease situation and the risk of disease entry into Viet Nam at each specific time.
The website “https://tokhaiyte.vn” is not used for health declarations
Another issue is that, at present, the Ministry of Health does not use the website at “https://tokhaiyte.vn” for health declarations by persons entering, exiting, or transiting Viet Nam. The Ministry of Health is currently developing a health declaration system. When health declarations are required, the Ministry will announce and open this system for the public to submit declarations. Under Decree No. 165/2026/ND-CP, health declarations may be submitted electronically or on paper. The health declaration form is attached to the Decree. The health declaration form provided by the Ministry of Health is available in two languages: Vietnamese and English. Health declarations must be made within seven days before entering, exiting, or transiting at Viet Nam’s border gates. In the event of an outbreak of an infectious disease, the Ministry of Health will, depending on the disease situation, issue additional guidance on health declarations at border gates.
